This version applies to new commitments from its effective date. Notice rules and conditions applicable to existing customers are preserved; this publication is not a retroactive amendment of their contracts.

1. Scope

Broco Pay supports the merchant-payment functions expressly enabled for a Personal payer and approved Pro merchant. These conditions supplement the Broco Terms of Use — Tunisia — Pro and the relevant balance conditions. The payment mechanism and provider roles must be identified for the activated service.

Broco is not automatically the seller of the purchased goods or services. The merchant's contractual duties to the buyer remain applicable. Broco remains responsible for the platform and payment obligations it undertakes.

2. Payment

Before confirming, the payer must be shown the merchant, amount, currency, applicable fee and method. An altered amount requires confirmation. A merchant must not treat an unconfirmed or pending instruction as finally settled unless its accepted rules expressly permit that treatment.

The payer receives a transaction reference and status. The merchant must provide any sale receipt required independently of the payment record. The two records must not misleadingly attribute the sale to a different entity.

Keep the payment reference and the seller's separate sale receipt.

3. Settlement

The merchant schedule states when accepted funds become available, any reserve lawfully agreed, settlement route and fees. Settlement statements must distinguish gross receipts, refunds, accepted fees and other justified adjustments.

Broco must not introduce an undisclosed reserve, confiscation rule or additional commission through a generic dashboard label. A reserve or restriction must have a valid disclosed basis and appropriate review.

4. Refunds and disputes

The merchant handles the underlying sale's performance and applicable customer remedies. A payment error or unauthorised transaction is handled under the payment framework and cannot be dismissed merely as a sale dispute.

A merchant refund must use a supported traceable route and identify the original transaction. A refund is not complete merely because a request was submitted. Mandatory rights concerning both the sale and payment remain available.

5. Merchant conduct

The merchant must describe its goods or services accurately, use its approved identity, comply with restrictions and disclose lawful charges. It must not split operations to evade limits, submit fictitious sales or use buyer data for unrelated purposes without a valid basis.

6. Information that applies to your operation

Your accepted offer, mandate or transaction confirmation supplies the variable commercial details for the operation. Those details must be available before you commit; a general reference to this page does not replace information required at that point.

Only the functions expressly enabled for you are included. Published catalogue content does not establish availability. Changes to accepted terms remain subject to the applicable notice and other mandatory requirements; updating a screen is not, by itself, consent to a material change.

7. Complaints and disputed operations

You can contact support@broco.app with a complaint about Broco. Describe the service, relevant transaction reference and issue; do not send passwords or authentication codes.

Where another provider is responsible for a part of the service, your accepted offer, mandate or confirmation explains the complaint route and escalation available. This does not remove your ability to complain about Broco's own acts or omissions.

Complaints are handled within the deadlines required by applicable law and by any mandatory provider process. Any extension must be lawfully permitted and explained. Complaint handling does not replace a statutory remedy. Urgent procedures, required provider deadlines and external dispute-resolution bodies are identified in the applicable service information for your jurisdiction.

You do not have to complete an internal process where applicable law permits direct access to an authority or court. Contractual complaint procedures do not shorten mandatory limitation or notification periods.

8. Responsibility and remedies

Broco is responsible for performing its own contractual obligations. Where a service is provided by another entity, your accepted offer, mandate or confirmation identifies each party's responsibilities. Another entity's involvement does not remove responsibility that applicable law places on Broco, including for acts or omissions attributable to Broco.

Nothing in these conditions excludes or restricts liability or remedies that cannot lawfully be excluded or restricted. This includes mandatory rights applicable to unauthorised or incorrectly executed transactions where the relevant legal regime provides them.

A security incident, incorrect recipient information or breach of a user obligation will be assessed on the facts and under the applicable law. It is not an automatic basis to reject every claim.

9. Tunisia: Local service rules

Financial, cash and cross-border functions are limited to the activated offer and the permissions of the actual providers. A global card or account description does not establish eligibility for every resident or authorise an unrestricted foreign-currency route. Your accepted offer, mandate or confirmation identifies the applicable provider, funding and return process and complaint route. A planned feature must not be treated as an active entitlement.
